Placing an order on the lourdes-shopping.fr web site implies that the customer agrees to the present General Terms and Conditions in their entirety and without exception, and to the article concerning Conditions of Ownership.

ARTICLE 2 - SCOPE

The present general terms and conditions of sale apply to the distance-selling operation of the company SARL Archipel Studios and cover all sales to its customers through the www.lourdes-shopping.fr web site, whether the customer is a professional company or a private individual.

The customer acknowledges, prior to placing an order, having fully read the information which constitutes the general terms and conditions of sale and having assessed the clauses of the present terms and conditions.

The company SARL Archipel Studios reserves the right to amend the present general terms and conditions of sale at any time. In this case, the conditions applicable are those in effect at the date the order is placed.

ARTICLE 3 - PRICES AND VAT

The price guaranteed to the customer is that which is in effect on the website at the moment the order is placed.

The product prices commercialised on the Lourdes Shopping web site are inclusive of all VAT (TTC – all tax included) and are guaranteed except when subject to a general modification of the French VAT rate. All changes to this VAT rate will immediately affect the product prices.

The product prices include transport costs for purchase orders of more than 100 € (all tax included) for metropolitan France, for purchase orders of more than 200 € (all tax included) for all other countries within the European Community and for purchase orders of more than 300 € (all tax included) for all other countries. Transport costs of 6 € will be applied for all purchase orders inferior to 100 € (all tax included) for metropolitan France and of 15 € for all purchase orders under 200 € (all tax included) to all other countries of the European Community. Transport costs of 20 € will be applied for all purchase orders inferior to 300 € (all tax included) for all other countries.

A detailed invoice will be addressed to the customer with the shipment. The indication of the VAT on the invoice allows professional companies to recuperate the VAT. The customer should keep the invoice as proof of purchase for the guarantee.

- Dispositions France's overseas departments & territories

All purchase orders which imply a delivery to France's overseas departments and territories is free of metropolitan France's VAT. This tax exemption concerns the products and the transport costs. The invoice will be automatically and fully calculated without tax. However, any customs duties, other local taxes, import duties that may apply upon arrival of the package are the sole responsibility of the customer.

- Dispositions for European countries

The products are subject to French tax (19.6% or 5.5% to date).

- Dispositions for non-EC countries

The client benefits from the exemption of tax on the products and transport. The invoice is calculated without French VAT. However, any customs duties, other local taxes, import duties that may apply upon arrival of the package in his country are the sole responsibility of the customer. The customer is also responsible for ensuring that the products ordered are authorised for importation to his country.

ARTICLE 4 — PAYMENT

Lourdes Shopping offers various methods of payment : credit card (CB, Visa or Mastercard), cheque, bank transfer, Paypal.

- On-line payment

The customer can pay his order directly, on-line, using a CB, Visa or Mastercard credit card : by indicating the 16 numbers on the card, the expiration date, and the last three figures of the visual cryptogram on the back of the card. The information is encrypted and transmitted in a secure environment compatible with SSL protocol (Secure Sockets Layer).

Only credit cards which present the logo CB, VISA or Mastercard, emitted in France or within the framework of the international network approved by the GIE Bank Cards, are accepted.

The debit is effective when the order is shipped, and only after having obtained authorisation from the competent payment centres for debiting the customers account. In the case of authorisation not being obtained, the order is not maintained.

The credit card details are only conserved for the period of order processing.

- Payment by cheque

Customers living in metropolitan France and Corsica who wish to pay by cheque should address their order form along with the payment by cheque payable to Archipel Studios by post to : Archipel Studios, Villa Transat, 3 rue Beauregard, 78430 Louveciennes, France.

The cheque will be cashed in the date of the shipment of the goods.

Note: in this case, it is necessary for the customer to indicate his name, first name, delivery address, telephone and e-mail along with the references and quantities he wishes to order.

- Payment by bank transfer

The bank transfer must be effective 7 days after placing the order, and the customer must indicate his order number so as to identify the transfer.

- Payment by Paypal

The payment through a PayPal account is accepted for all order superior than 1 € (all tax included). Orders paid using a PayPal account are entered and validated upon acceptation of the payment by PayPal. To know more about the use of PayPal, click here.

ARTICLE 5 — PRODUCT DESCRIPTION

The products proposed on the Lourdes Shopping web site are conform with French legislation to date and with standards applicable in France. The photos, texts, drawings and characteristics reproduced and illustrating the products are not contractual. Archipel Studios cannot, by consequence, be held responsible in the case of error or omission in one of these photos, texts or drawings or characteristics of the products or in the case of modification of these characteristics by the manufacturers.

ARTICLE 6 — RETRACTION RIGHTS - SATISFIED OR REIMBURSED

Following article L 121-20 of the Consumption Code, the customer has 7 working days upon reception of his order to return a product which does not satisfy him, with the a copy of the corresponding invoice.

Upon reception of the returned goods, and under the condition that the product is in its original state and packaging (without any visible or functional deterioration and perfectly clean), we will proceed with the reimbursement. This procedure takes approximately 7 days, by bank transfer or by cheque to the address on the invoice.

We invite the customer to send us a short, explicit note indicating the precise nature of the problem encountered so that we can solution it.

The customer is liable for the return postage and Archipel Studios for the dispatch of the package back to the customer at the address indicated.

Except otherwise informed by Archipel Studios, the return of goods should be sent to the following address : Coecilia/Lourdes-shopping.fr, 23 place Monseigneur Laurence, 65100 Lourdes, France.

ARTICLE 7 - AVAILABILITY AND DELIVERY DELAYS

Products and prices are valid as advertised on www.lourdes-shopping.fr subject to stock availability. Should a product be unavailable after the customer has placed his order, he will be informed by e-mail within a delay of 7 days from the order date so as to inform him within which time delay the product can be delivered along with any possible tariff modifications.

The delays indicated are purely indicative for articles available in stock:

- Count around 2 days for a shipment to metropolitan France/Corsica by Chronopost.

- Count around 4 to 10 working days for the rest of the world.

In the case of several articles being available at different dates, and according to their availability, the delivery delay will be based upon the longest delay. Archipel Studios reserves the right to make partial deliveries. Archipel Studios cannot be held responsible for the consequences incurred by a late delivery.

ARTICLE 8 - DELIVERY

Products are delivered to the address given when the order was placed.

The delivery is considered effective upon remittance of the goods to the transport company. The delivery note presented by the transport company, dated and signed by the client upon delivery of the goods and containing a delivery note reference number constitutes proof of transport and delivery of the order.

By express agreement, the transport company is a representative of the client. It is therefore the responsibility of the client to make any claim directly to the transport company regarding any motive of disagreement (late delivery, partial or total loss, irregularities) and, in no case whatsoever, can the responsibility of Archipel Studios be implied.

Concerning the dispositions to be taken by the customer towards the transport company driver, and for information only, Archipel Studios informs the customer that he should, upon delivery of the goods, proceed with the verification that the products are conform and in good condition before signing the acknowledgement of receipt of the shipment. The products should correspond to the quantity and quality of the indications on the delivery note.

If the customer notices irregularities during this verification, he should refuse the delivery of one or several of the ordered products, or indicate his reservations on the acknowledgement of receipt slip. These reservations must be precise, dated and signed on the acknowledgement of receipt slip and confirmed by letter (recorded delivery) to the transport company within 10 days of the delivery (with a copy sent to Arcipel Studios for information). The client should keep a copy of this acknowledgement of receipt slip with the indication of his reservations.

ARTICLE 9 - INTELLECTUAL PROPERTY

All text, notes, work, illustrations and images…and in a more general manner everything that can be read and visualised on the www.Lourdes-shopping.fr web site, are protected by the intellectual property law worldwide. In accordance with the provisions of Intellectual Property legislation, private use only is permitted and any other use without prior authorisation of Archipel Studios is an infringement of the authors copyright and a violation of intellectual property rights.

Certain products such as music and films are subject to specific rights of use, which regulate copies, public diffusion, renting….The customer must respect the general terms and conditions of sale of these products and lourdes-shopping cannot be held responsible of any use made of these products in this context.

ARTICLE 10 - CLIENT CONFIDENTIALITY

In order to meet the requirements of our clients and to ensure an on-line distance service, we are obliged to collect certain personal information concerning the customer, such as his surname and first name, address, etc. This information is confidential and will only be used by internal departments for processing the customers' orders. This information will not, under any circumstance, be divulged to third parties.

In accordance with the Data Protection Act 1998, the customer has the right to access, correct and object to any personal information relating to him.

The customer engages, when registering to the web site, to provide true and sincere information about himself. The communication of false information is contrary to the present terms and conditions of sale.

ARTICLE 11 - CONDITION OF OWNERSHIP

In application of the Law of 12th May 1980, all goods remain the property of Archipel Studios until the receipt of payment in full including added interest if appropriate. This provision does not affect the transfer to the customer of all risks of loss, theft or damage from the moment the goods leave our premises.

The non-payment of the customer, for whatever the reason, gives the sales company the right to demand the immediate restitution of the delivered goods, all cost and risk being on the buyers’ side. Archipel Studios reserves the right to cancel all orders from a client who as already had anterior payment contention issues.

ARTICLE 12 - APPLICABLE LAW

In the event of a point of contention, the parties will look for an amicable settlement to any disagreement as a result of the execution of the present terms and conditions of sale.

For lack of an amicable arrangement, any disagreement that stems from the present contract will be submitted to French law and shall be governed by the jurisdiction of Versailles (France).
